These Terms of Service ("Terms") govern your use of NeverQuits.ai ("NeverQuits," "we," "us," or "our") and the services we provide. By creating an account or using our services, you agree to these Terms.

1. Services

NeverQuits provides AI-powered business systems for local service businesses, including:

AI Receptionist — answers calls 24/7, books appointments
AI Twin Social Posts — generates and publishes posts in your face/voice
Comment-to-DM Lead Capture — auto-DMs commenters on your social posts
Review Autopilot — requests and manages customer reviews
Lead Follow-Up Automation — text, email, and DM sequences
Monthly Performance Report — analytics summary

Service deliverables and inclusions may change as we improve the platform; material changes will be communicated by email.

2. Subscription & Billing

NeverQuits Growth System (Service B): Pricing fits your business, no setup fee, no contract
Always-On Downsell: Backend automation only (offered if you cancel Service B)
Website-in-a-Box (Service A): Custom pricing, no setup fee
Billing is monthly via Stripe, recurring on the same date each month
The first month is charged at signup; subsequent months charge on the same date each month in advance

3. Cancellation

You can cancel at any time with no contract and no early-termination fee. Cancellation takes effect at the end of your current billing period. Already-charged monthly fees are non-refundable.

For Service A: upon cancellation, the domain we registered for you remains under our ownership and the website goes offline. You may purchase the domain from us at our then-current rate.

4. Your Responsibilities

You agree to:

Provide accurate business information and keep it current
Authorize us via OAuth to connect your social accounts, calendar, and payment processors
Comply with all applicable laws (CAN-SPAM, TCPA, GDPR, your industry's regulations including HIPAA where applicable)
Not use NeverQuits for spam, fraud, illegal services, or harassment
Approve or reject AI-drafted content before it publishes if you enable approval mode
Maintain control over what your AI receptionist and AI twin say (we provide tools; you provide the rules)

5. Our Responsibilities

Provide the services as described
Use commercially reasonable efforts to maintain uptime and accuracy
Notify you of material changes to your services
Respond to support requests within 24 hours on business days
Maintain the security of your data per our Privacy Policy

6. Acceptable Use

You may not use NeverQuits for:

Adult content, gambling, weapons, illegal drugs, MLM/pyramid schemes, or get-rich-quick offers
Unsolicited bulk SMS or email
Impersonating another person or business
Reverse-engineering, copying, or reselling the NeverQuits platform itself

We reserve the right to terminate accounts that violate these rules without refund.

7. Intellectual Property

Your content: You own your business data, customer data, voice/face recordings, and any content you upload. You grant us a license to use it solely to provide the services.
AI-generated content: Output generated for your business (posts, scripts, replies) is yours to use freely.
NeverQuits platform: We own the software, prompts, workflows, and infrastructure. You receive a non-transferable license to use it during your subscription.

8. AI Twin Specifics

If you use the AI Twin feature, you grant us a limited license to:

Train an AI voice/face model on your provided audio and video samples
Generate posts, calls, DMs, and other communications using that model
Use the model only for your account; we will not use it for other customers, marketing, or training general models

Upon cancellation, we will delete your AI twin model within 30 days. We are not liable for misuse if you share your account credentials.

9. Disclaimers & Liability

NeverQuits provides services "AS IS." We do not guarantee specific results (number of leads, revenue, conversion rates). AI-generated content may contain errors; you are responsible for reviewing material output.

To the maximum extent permitted by law, our liability is limited to the amount you paid us in the 12 months prior to the claim.

10. Indemnification

You agree to defend and indemnify NeverQuits from claims arising out of:

Your business operations or end-customer interactions
Your violation of these Terms or applicable law
Content you provide or approve for publishing

11. Changes to Terms

We may update these Terms; we will email you 30 days before material changes take effect. Continued use of NeverQuits after the effective date means you accept the new Terms.

12. Governing Law

These Terms are governed by the laws of Washington State, USA. Any disputes will be resolved in courts located in Pierce County, Washington.
